Novaread Terms of Use

1. Account Eligibility and Acceptance

• Age Requirement: You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account, manage child profiles, and initiate subscriptions. The App is intended to be set up and managed solely by adults.
• Acceptance: By creating an account or subscribing to our service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

2. Account Registration and Parental Responsibility

• Account Security: You are responsible for maintaining the confidentiality of your login credentials and the parental PIN code configured within the App. You agree to accept responsibility for all activities that occur under your account.
• Child Profiles: The App allows account holders to log reading activity for their children. You agree to enter only non-identifying information, such as first names or nicknames, for child profiles. You maintain full control and authority over all profile entries and reading logs associated with your account.
• Parental Controls: The parental PIN feature is provided to restrict child access to settings and external links. You acknowledge that maintaining the security of this PIN on your device is your sole responsibility.

3. Subscriptions, Billing, and Cancellations

• Auto-Renewal Subscriptions: Access to full App features requires a paid subscription. Subscriptions automatically renew at the end of each billing period (monthly or annually) at the then-current price, unless cancelled at least 24 hours prior to the end of the current billing cycle.
• Payment Processing: All payments, subscriptions, and billing transactions are processed directly through the third-party app store/website where you downloaded the App (e.g., Apple App Store or Google Play Store). Payments are subject to the terms, conditions, and privacy policies of the respective app store/Stripe.
• Free Trials: If offered, free trial periods grant access for a specified duration. Unless cancelled prior to the trial expiration, the trial will automatically convert into a paid, auto-renewing subscription charged to your store account.
• Cancellations and Refunds: You may cancel your subscription at any time via your Stripe, Apple ID or Google Play Account Settings. We do not process refunds directly within the Apple or Google payment portals. All refund requests are subject to the policies and discretion of the relevant place of purchase.

4. Permitted Use and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial family use on compatible devices.

You agree not to:

• Copy, modify, distribute, or reverse-engineer any portion of the App.
• Circumvent, disable, or interfere with security features, including the parental PIN gate.
• Use automated tools, scripts, or scraping software to collect information from the App.
• Use the App for any illegal purpose or in violation of local, state, national, or international laws.

5. Intellectual Property Rights

• App Content: All software, design, logos, software code, graphics, and interactive features within the App are owned by or licensed to Novaread and are protected by intellectual property laws.
• User Content: You retain ownership of any reading logs, custom titles, or notes you submit to the App. By submitting content, you grant us a limited, worldwide license to store and process this data solely to provide and maintain the App's services to you.

6. Account Termination and Deletion

• Termination by You: You may terminate these Terms at any time by deleting your account through the in-app settings menu (Settings > Account > Delete Account) and uninstalling the App.
• Termination by Us: We reserve the right to suspend or terminate your account or access to the App at our sole discretion, without prior notice, if you violate these Terms or engage in fraudulent or abusive behavior.
• Data Deletion: Upon account deletion, your account data and associated child profile logs will be permanently removed from our active databases in accordance with our Privacy Policy.

7. Limitation of Liability and Disclaimers

• Provided "As-Is": The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
• Educational Disclaimer: Novaread is a tracking and organizational tool. We make no guarantees regarding specific educational outcomes, literacy achievements, or reading speed improvements resulting from the use of the App.
• Limitation of Liability: To the maximum extent permitted by applicable law, Novaread shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to, or inability to access or use, the App.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the UK, without regard to its conflict of law principles.

9. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of any material changes by updating the "Last updated" date at the top of these Terms or by providing notice within the App. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
